Terms of Service

These Terms of Service ("Terms") govern your use of the NetXol website at https://netxol.com, the demo and trial environments we may grant you, and the content we publish. By using the site you agree to be bound by these Terms.

1. About NetXol

NetXol Technologies ("NetXol", "we", "us", "our") is a software and services company headquartered in Riyadh, Kingdom of Saudi Arabia, with operating offices in Lahore (Pakistan) and Madrid (Spain). We build NetXol One Suite — an AI Operating System for FTTH Internet Service Providers — comprising NMM (Network Management), CRM (Customer Management) and ERP (Business Management) modules.

2. Use of this website

• You may use the website to learn about NetXol, request information, download permitted resources, or interact with the forms we provide.
• Content on the site is for information only and may be updated, changed or removed without notice.
• You agree not to interfere with the site, attempt unauthorised access, or use it to harm any other person, including by scraping at volumes that affect availability for others.
• You may link to the site freely. You may not frame, mirror or redistribute the site in a way that misleads about its origin.

3. Forms and submissions

When you submit a contact form or an RFP, you confirm that the information is accurate, that you are authorised to share it, and that any document you attach can lawfully be shared with NetXol for the purpose of scoping a response. We handle submissions under our Privacy Policy.

4. Trials and demo environments

NetXol may grant you a non-exclusive, non-transferable, time-limited right to access a trial or demo instance for the purpose of evaluating our products. Trials may be revoked or expired at our discretion. Any feedback or improvement suggestions you provide during a trial may be used by NetXol without obligation to you.

5. Intellectual property

• The website, our products, the NetXol name and logo, and all associated software, documentation and content are the intellectual property of NetXol Technologies or its licensors.
• No licence under any patent, trade mark, copyright or other intellectual property right is granted by these Terms except as expressly stated.
• Open-source components, where used, are governed by their own licences — we make those licences available on request.

6. Acceptable use

When using the website, demos or any service we make available, you agree not to:

• Use it to violate any law, regulation, or third-party right.
• Reverse-engineer, decompile or attempt to derive source code from any NetXol software except to the extent permitted by mandatory law.
• Interfere with the integrity or performance of the service, or attempt to gain unauthorised access to any account or system.
• Use the service to send unsolicited commercial messages or to host malicious content.
• Resell, sublicense or redistribute the service without prior written authorisation.

7. Confidentiality

During trials and commercial engagements, each party may receive confidential information from the other (product roadmaps, pricing, source code, network architecture). Each party will use confidential information only for the purposes contemplated by these Terms or the MSA, and will protect it with at least the same care it uses for its own confidential information.

8. Pricing, payment and taxes

Pricing for NetXol products is provided on request and set out in your Order Form / MSA. Where applicable, all prices are exclusive of taxes, duties and levies, which you are responsible for paying as required by law. Payment terms are stated in your Order Form.

9. Warranties and disclaimers

The website and any content, demos or trial environments are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy or non-infringement, except to the extent that the law of your jurisdiction makes such disclaimers unenforceable. Warranties applicable to NetXol products in commercial use are stated in your MSA.

10. Limitation of liability

To the maximum extent permitted by law, NetXol will not be liable for any indirect, special, incidental, consequential or exemplary damages, including loss of profits, revenues, data or business opportunity, arising out of or in connection with your use of the website, demos or trials. NetXol's total aggregate liability arising from your use of this website (excluding paid services under an MSA) is limited to USD 100. Limits applicable to commercial services are set out in your MSA.

11. Indemnification

You will defend, indemnify and hold harmless NetXol from any claim, loss or expense arising from your breach of these Terms, your unlawful use of the website, or your infringement of any third-party right.

12. Term and termination

These Terms remain in force while you use the website. We may suspend or terminate your access at any time if we reasonably believe you have breached these Terms or to comply with a legal obligation. Sections that by their nature should survive termination (IP, Confidentiality, Disclaimers, Liability, Governing Law) will survive.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Kingdom of Saudi Arabia. The courts of Riyadh have exclusive jurisdiction over any dispute, except that NetXol may bring proceedings to protect its intellectual property in any jurisdiction where the infringement occurs. Where an MSA is in place, the law and forum set out in that MSA prevail.

14. Changes to these Terms

We may update these Terms from time to time. The updated version takes effect when posted to this page. For material changes that affect ongoing commercial relationships, we will notify you separately. Continued use of the website after the change constitutes acceptance.
